auction will be prevailing sales price. 4% buyer's premium added to final bid.

Terms and Conditions
Please read the terms and conditions carefully, as they are a legal binding contract between the bidder and Black & Gold Auctions. By registering to bid, you are agreeing and bound to the said terms and conditions.
1. REGISTRATION: This is an online-only auction. All participants must register
online to place bids and must agree to the Auction Terms and Conditions. By
registering, each bidder acknowledges that they have read, understood, and agreed
to be bound by these terms. Registration constitutes an unconditional and
irrevocable agreement to comply with all terms of the auction, including any
additions, deletions, discoveries, or revisions made by the Auctioneer prior to the
start of the auction.
2. SPECIAL NOTES: All property is sold AS IS, WHERE IS, with no warranties,
expressed or implied, by Black and Gold Auctions or the Seller. Any personal property
remaining at closing will transfer with the real estate.
The winning bidder must sign the purchase contract and submit the required earnest
money deposit by the end of the auction day. Failure to do so will be considered a
default.
If the winning bidder does not submit the signed contract and deposit, Black and Gold
Auctions reserves the right to:
Charge a $1,000 penalty fee to the credit card used during registration
Pursue additional default remedies as outlined in the Auction Terms and the
Contract for Sale
Offer the property to the second-highest bidder
3. AUCTION END TIMES
Black and Gold Auctions' online auctions are timed events. If a bid is placed within the
final 3 minutes, the countdown will reset to 3 minutes. If bidding continues beyond 15
minutes, the reset time changes to 2 minutes. This auto-extend process continues
until no further bids are received during the extended period.
4. ACCEPTANCE OF FINAL BID
Seller reserves the right to accept the final bid. Starting bids of $250,000
5. BUYER'S FEE
A 4% buyer’s premium will be added to the high bid to determine the total purchase
price.
Example: A $100,000 bid results in a $104,000 purchase price.
6. DOWN PAYMENT
The winning bidder must submit a $10,000 non-refundable earnest money deposit
(personal check, business check, certified check, or wire) by the end of auction day.
Buyer is responsible for any wire fees. Remaining balance is due at closing within 30
days.
7. FINANCING
This is a cash sale with no financing contingency. Bidders are strongly encouraged
to secure financing prior to bidding.
8. AUCTION CONTRACT
The successful bidder must sign the auction purchase contract and submit the earnest
money by the close of business on auction day.
9. CLOSING & COSTS
Closing must occur within 30 days of the auction. Closing company to be Boone
Central Title Company, Columbia Missouri.
Buyer pays all standard buyer-side closing costs (e.g., title company fees, loan
fees, recording fees).
Seller covers seller-side closing costs (e.g., title insurance, preparation fees).
10. POSSESSION
Buyer receives possession at closing.
11. EVIDENCE OF TITLE
Seller will provide, at their expense, an Owner’s Title Insurance Policy for the full
purchase amount and will convey title via Warranty or Trustee’s Deed. Relevant legal
documents and easements are available at www.blackandgoldauctions.com.
12. SURVEY
No boundary survey will be provided. Acreage and boundaries are approximate, based
on County Assessor data. Aerial images are for illustration only.
13. TAXES & ASSESSMENTS
Seller will pay any unpaid taxes. Property taxes will be prorated to closing.
14. AGENCY
Black and Gold Auctions and its agents represent the Seller exclusively.
15. BROKER PARTICIPATION
A commission will be paid to licensed brokers who register a successful bidder using
the Broker Participation Form, submitted 48 hours before the auction. No commission
is paid to agents buying for themselves.
16. DISCLAIMER
All information provided on blackandgoldauctions.com or third-party sites is believed
accurate but not guaranteed. On-site inspection is strongly recommended. Failure to
inspect will not be grounds for bid withdrawal, claim, or refund. This includes zoning,
easements, right-of-ways, and other public records.
17. DISPUTES
Any disputes will be resolved in the Boone County, Missouri court system. By bidding,
buyers agree to all auction terms.
18. HOLD HARMLESS
Bidders agree to hold harmless and indemnify Black and Gold Auctions and its
representatives from any claims, damages, or legal actions arising from participation in
the auction.
19. TECHNICAL ISSUES
In the event of technical issues with the auction platform, Black and Gold Auctions may
extend, pause, or close bidding as necessary. Neither the software provider nor Black
and Gold Auctions is responsible for missed bids or technical failures. Email updates
will be sent as needed.
